Este artículo es el resultado de una investigación del programa de Maestría en Educación de la universidad la Gran Colombia; se propuso como objetivo general determinar cómo construyen la categoría “valor” estudiantes de grado once de dos colegios de la ciudad de Bogotá, con edades que oscilan entre quince y diecinueve años respectivamente. El enfoque metodológico fue de carácter cualitativo en el cual se utilizaron las técnicas de recolección de información: grupos focales y entrevistas a profundidad, que tuvieron el propósito (...) de recoger e interpretar la asignación de sentidos y representaciones expresadas en las narrativas de los actores participantes. Algunos de los hallazgos sugieren que las percepciones de la población objeto de estudio sobre la categoría “valor” están relacionadas con procesos de subjetivación que se construyen en la vida cotidiana en dinámicas complejas y no necesariamente lineales, como resultados de acuerdos sociales. De otra parte, existe una tendencia significativa a construir la categoría “valor” de acuerdo con las necesidades, intereses y motivaciones que se generan en el contexto escolar, lo que produce conflictos, contradicciones y valoraciones morales que muchas veces devienen en lucha de fuerza con las instituciones. Se destaca entre otras conclusiones, el juego en que se sumergen los estudiantes a partir de prácticas éticas asociadas a la categoría “valor” de carácter teleológico, porque las conductas intentan evitar un castigo o alcanzar un premio; y autotélicas porque los comportamientos producen felicidad en el hacer. In the context of a didactic for learning and updating the texts and classical languages, this work proposes a translation and interpretation of the philosophical and political sense of the fable The Aged Horse of Babrius. The translation follows the Greek version of Crusius and the Gredos edition, while the interpretation is based on the philosophical and political reflections of Cicero and Plutarch in On old Age and Whether an old man should engage in plublic affairs. These reflections can also (...) be seen from a statistical analysis of Long-Lived Men of Lucian of Samosata. Thus, the meaning of the fable says that young statesmen should avoid becoming the next useless politicians or “old horses” of the State. This reflection contributes today to weigh the political participation of young people and updates the civic importance of the elderly in their intervention on public affairs. (shrink)

It was with Emile Durkheim , the architect of a classic paradigm for sociology, that radiates to otherparadigms of major theorists, who succeeded him, that sociology came to be considered a science, with an empirical basis and its own methods of research; he showed that its object of study, social facts, would have characteristics that distinguish it from those studied by other sciences. I believe that I done a timid approach, from first readings, that revealed a complex theoretical universe, with awide range of concepts, and a fascination that makes it difficult to stop the readings. The current assessment of behaviors in the inventories to diagnose autism spectrum disorders (ASD) focus on observation and discrete categorizations. Behaviors require movements, yet measurements of physical movements are seldom included. Their inclusion however, could provide an objective characterization of behavior to help unveil interactions between the peripheral and the central nervous systems. Such interactions are critical for the development and maintenance of spontaneous autonomy, self-regulation and voluntary control. At present, current approaches cannot deal with the heterogeneous, dynamic and stochastic (...) nature of development. Accordingly, they leave no avenues for real-time or longitudinal assessments of change in a coping system continuously adapting and developing compensatory mechanisms. We offer a new unifying statistical framework to reveal re-afferent kinesthetic features of the individual with ASD. The new methodology is based on the non-stationary stochastic patterns of minute fluctuations (micro-movements) inherent to our natural actions. Such patterns of behavioral variability provide re-entrant sensory feedback contributing to the autonomous regulation and coordination of the motor output. From an early age, this feedback supports centrally driven volitional control and fluid, flexible transitions between intentional and spontaneous behaviors. We show that in ASD there is a disruption in the maturation of this form of proprioception. Despite this disturbance, each individual has unique adaptive compensatory capabilities that we can unveil and exploit to evoke faster and more accurate decisions. Measuring the kinesthetic re-afference in tandem with stimuli variations we can detect changes in their micro-movements indicative of a more predictive and reliable kinesthetic percept. Our methods address the heterogeneity of ASD with a personalized approach grounded in the inherent sensory-motor abilities that the individual has already developed. (shrink)

Ontologies, as the term is used in informatics, are structured vocabularies comprised of human- and computer-interpretable terms and relations that represent entities and relationships. Within informatics fields, ontologies play an important role in knowledge and data standardization, representation, integra- tion, sharing and analysis. They have also become a foundation of artificial intelligence (AI) research. In what follows, we outline the Coronavirus Infectious Disease Ontology (CIDO), which covers multiple areas in the domain of coronavirus diseases, including etiology, transmission, epidemiology, pathogenesis, diagnosis, (...) prevention, and treatment. COVID-19 often manifests with different outcomes in different patients, highlighting the complexity of the host-pathogen interactions involved in manifestations of the disease at the molecular and cellular levels. In this paper, we propose a set of postulates and a framework for systematically understanding complex molecular host-pathogen interaction networks. Specifically, we first propose four host-pathogen interaction (HPI) postulates as the basis for understanding molecular and cellular host-pathogen interactions and their relations to disease outcomes. These four postulates cover the evolutionary dispositions involved (...) in HPIs, the dynamic nature of HPI outcomes, roles that HPI components may occupy leading to such outcomes, and HPI checkpoints that are critical for specific disease outcomes. Based on these postulates, an HPI Postulate and Ontology (HPIPO) framework is proposed to apply interoperable ontologies to systematically model and represent various granular details and knowledge within the scope of the HPI postulates, in a way that will support AI-ready data standardization, sharing, integration, and analysis. As a demonstration, the HPI postulates and the HPIPO framework were applied to study COVID-19 with the Coronavirus Infectious Disease Ontology (CIDO), leading to a novel approach to rational design of drug/vaccine cocktails aimed at interrupting processes occurring at critical host-coronavirus interaction checkpoints. Furthermore, the host-coronavirus protein-protein interactions (PPIs) relevant to COVID-19 were predicted and evaluated based on prior knowledge of curated PPIs and domain-domain interactions, and how such studies can be further explored with the HPI postulates and the HPIPO framework is discussed. The global spread of the novel coronavirus is affected by the spread of related misinformation—the so-called COVID-19 Infodemic—that makes populations more vulnerable to the disease through resistance to mitigation efforts. Here, we analyze the prevalence and diffusion of links to low-credibility content about the pandemic across two major social media platforms, Twitter and Facebook. We characterize cross-platform similarities and differences in popular sources, diffusion patterns, influencers, coordination, and automation. Comparing the two platforms, we find divergence among the prevalence of popular (...) low-credibility sources and suspicious videos. A minority of accounts and pages exert a strong influence on each platform. These misinformation “superspreaders” are often associated with the low-credibility sources and tend to be verified by the platforms. On both platforms, there is evidence of coordinated sharing of Infodemic content. The overt nature of this manipulation points to the need for societal-level solutions in addition to mitigation strategies within the platforms. However, we highlight limits imposed by inconsistent data-access policies on our capability to study harmful manipulations of information ecosystems. (shrink)

The current COVID-19 pandemic and the previous SARS/MERS outbreaks of 2003 and 2012 have resulted in a series of major global public health crises. We argue that in the interest of developing effective and safe vaccines and drugs and to better understand coronaviruses and associated disease mechenisms it is necessary to integrate the large and exponentially growing body of heterogeneous coronavirus data. Ontologies play an important role in standard-based knowledge and data representation, integration, sharing, and analysis. Accordingly, we initiated the (...) development of the community-based Coronavirus Infectious Disease Ontology in early 2020. -/- As an Open Biomedical Ontology (OBO) library ontology, CIDO is open source and interoperable with other existing OBO ontologies. CIDO is aligned with the Basic Formal Ontology and Viral Infectious Disease Ontology. CIDO has imported terms from over 30 OBO ontologies. For example, CIDO imports all SARS-CoV-2 protein terms from the Protein Ontology, COVID-19-related phenotype terms from the Human Phenotype Ontology, and over 100 COVID-19 terms for vaccines (both authorized and in clinical trial) from the Vaccine Ontology. CIDO systematically represents variants of SARS-CoV-2 viruses and over 300 amino acid substitutions therein, along with over 300 diagnostic kits and methods. CIDO also describes hundreds of host-coronavirus protein-protein interactions (PPIs) and the drugs that target proteins in these PPIs. CIDO has been used to model COVID-19 related phenomena in areas such as epidemiology. The scope of CIDO was evaluated by visual analysis supported by a summarization network method. CIDO has been used in various applications such as term standardization, inference, natural language processing (NLP) and clinical data integration. We have applied the amino acid variant knowledge present in CIDO to analyze differences between SARS-CoV-2 Delta and Omicron variants. CIDO's integrative host-coronavirus PPIs and drug-target knowledge has also been used to support drug repurposing for COVID-19 treatment. -/- CIDO represents entities and relations in the domain of coronavirus diseases with a special focus on COVID-19. It supports shared knowledge representation, data and metadata standardization and integration, and has been used in a range of applications. (shrink)

Proponho comparar e aproximar as fundamentações normativas para o socialismo de Axel Honneth e John Rawls. Parto, para tanto, de alguns traços da teoria de Honneth desenvolvidos em seu escrito sobre socialismo e dos próprios contrastes estabelecidos por ele frente ao projeto de Rawls. Destrincho a comparação em duas frentes: a primeira, tratando do conteúdo normativo das noções de liberdade de ambos os autores, a segunda, tratando do que Honneth e outros autores da tradição da teoria crítica chamam de (...) base social ou imanente das teorias. Da primeira, concluo que o contraste estabelecido por Honneth entre o seu ideal de liberdade social e o ideal de liberdade encontrado na filosofia política de Rawls não encontra respaldo em uma análise acurada da proposta rawlsiana, e que a filosofia de Rawls também pode fornecer uma normatividade crítica para o Socialismo. Da segunda, concluo, a despeito da crítica de Honneth de que haveria uma deficiência ‘prático-política’ na filosofia de Rawls, que é possível encontrar na obra deste, de uma forma mais ou menos similar àquela do autor alemão, os três elementos que Honneth julga serem necessários para uma teoria crítica que não queira ser apenas uma crítica ‘puramente normativa’ da sociedade. Intervention studies with developmental samples are difficult to implement, in particular when targeting demographically diverse communities. Online studies have the potential to examine the efficacy of highly scalable interventions aimed at enhancing development, and to address some of the barriers faced by underrepresented communities for participating in developmental research. During the COVID-19 pandemic, we executed a fully remote randomized controlled trial language intervention with third and fourth grade students from diverse backgrounds across the United States. Using this as a case (...) study, we discuss both challenges and solutions to conducting an intensive online intervention through the various phases of the study, including recruitment, data collection, and fidelity of intervention implementation. We provide comprehensive suggestions and takeaways, and conclude by summarizing some important tradeoffs for researchers interested in carrying out such studies. (shrink)

Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria, prognosis and expected benefit of ventilation, (...) and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. Este artigo tem o objetivo de apresentar e desenvolver as críticas feministas à Teoria da Justiça de John Rawls, especialmente por meio do diálogo e das contribuições de Martha Nussbaum e Susan Okin para um liberalismo feminista. Para tanto, discutimos três pontos centrais no debate entre essas duas filósofas feministas e Rawls: a) a noção de família como uma instituição básica da sociedade; b) a distinção entre doutrinas morais abrangentes razoáveis e não razoáveis; e c) a concepção de pessoa (...) política com autonomia plena. As críticas à teoria rawlsiana feitas por feministas demonstram a riqueza e a profundidade de Rawls para o liberalismo contemporâneo, ao mesmo tempo em que apontam para os problemas que teorias que tradicionalmente não desenvolvem um olhar crítico para a situação generificada dos sistemas democráticos encontram ao abordar a situação da cidadania das mulheres. As demandas do feminismo liberal, relacionadas à situação de mulheres ao redor do mundo, são muito bem-articuladas por Nussbaum a partir de sua crítica interna ao liberalismo rawlsiano, enfatizando que algumas das disposições teóricas desse autor não parecem ser radicais o suficiente para garantir a disponibilidade integral dessas capacidades para mulheres e crianças. Da mesma forma, o diálogo de Nussbaum com as críticas de Okin aprofundaram o debate sobre os limites da teoria da justiça rawlsiana. (shrink)

A maior parte das citações é parcial e contradiz o conjunto da doutrina. Parece ser mais fácil chamar para conversação William James e John Dewey do que chamar seu inspirador comum. A razão última deste desafio parece se encontrar na radicalidade do realismo falibilista, dificilmente aceitável pela maioria das filosofias (...) atuais. The increasingly frequent references to Peirce's thought made by the contemporary Philosophy of Science are not able to conceal the difficulty found in assuming that thought in its entireness. The most part of the quotations made are partial and contradict the whole of the doctrine. It seems easier to call James and Dewey to conversation than to call their common inspirer. The ultimate reason for this challenge seems to lie in the radicality of the fallibilist realism, hardly acceptable by almost all the present philosophical currents. (shrink)

Este trabalho tem como objetivo apresentar e discutir a filosofia da experiência de John Dewey, enfatizando suas concepções sobre experiência, experiência educativa e propósito. Além disso, apresentar e discutir como os projetos de programação desenvolvidos por crianças no Scratch podem ser entendidos como um propósito no contexto de sua filosofia, o que nos levou a relacionar o conceito de propósito construído por Dewey à ideia de projeto pessoal desenvolvida por Papert, no âmbito do construcionismo. Tal relação se torna importante (...) para ampliar as investigações que tratam problemáticas relacionadas ao ensino de programação na educação básica. A fim de exemplificar as possíveis relações, apresentamos um projeto de programação desenvolvido por um aluno do quinto ano do ensino fundamental, reconhecendo nele os pressupostos teóricos da teoria de Dewey discutidos no texto, relacionando-os às ideias de Papert. As we have discussed elsewhere, Franz Boas and John Dewey were intellectual and political allies at Columbia University for over thirty years.1 Dewey advocated for an increased role of anthropology for philosophical insight, and he often used anthropological knowledge as a starting point for his ethics and politics, including such knowledge as learned from Boas. O artigo tem por objeto o exame de três registros de gritantes e distintos paradoxos na Doutrina do Direito de Kant. Registros feitos em tempos e contextos históricos diferentes por Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek atribuiu a Kant a mais paradoxal das proposições jamais enunciadas por qualquer autor, a de que a mera ideia de soberania deve obrigar-nos a obedecer como a nosso inquestionável senhor a quem quer que se haja estabelecido como tal, sem que (...) caiba indagar quem lhe deu o direito de comandar-nos. Willaschek aponta a incompatibilidade de duas teses centrais da doutrina kantiana: a do caráter externo dos vínculos jurídicos e a da incondicionalidade obrigacional do direito positivo, pois não é possível entender como é possível termo-nos como obrigados por imperativos jurídicos e, ao mesmo, vermo-nos internamente isentados do dever de obedecê-los. O ponto crítico de Balthazar é alegar que não pode haver na filosofia kantiana uma crítica da razão político e jurídica, simplesmente porque o conceito de imputação, base da normatividade própria dessas esferas, pressupõe uma pluralidade de agentes livres que, justamente, só pode ser uma pressuposição, pois nosso acesso à normatividade prática só pode ter lugar em primeira pessoa. No exame a que o artigo submete essas alegações, o artigo argumenta, em objeção à tese de Balthazar, que o caráter universal e categórico da força que vincula o sujeito quando confrontado com a lei moral em primeira pessoa necessariamente se desvaneceria se, ao mesmo tempo, ele não fosse tomado pela evidência de que a realidade objetiva dos princípios morais é não só instanciável, mas assegurada pela múltipla instanciação. Com relação às dificuldades levantadas por Willaschek e Bouterwek, o artigo argumenta que o princípio exeundum e statu naturali, enquanto norma metapositiva, anterior à divisão do domínio prático entre doutrina do direito e doutrina da virtude, permite ao mesmo tempo compreender a exigência de obediência ao poder constituído e a restrição das obrigações jurídico-políticas exclusivamente ao foro externo.AbstractThe object of the article is to examine three claims about three distinct and allegedly blatant paradoxes in Kant's Doctrine of Right. These three critical points had been made in distinct times and contexts by Friedrich Bouterwek, Marcus Willaschek e Balthazar Barbosa Filho. Bouterwek attributed to Kant the most paradoxical of all paradoxical propositions, the statement that by the mere idea of sovereignty we are obliged to obey as our lord who has imposed himself upon us, without questioning from where he got such right. Willaschek points out the incompatibility of two main theses of Kantian doctrine of right: the claims that the legal bounds are of external character and that they are the source of unconditional obligations, since it seems impossible to understand how it would be possible to be obliged by juridical norms and decisions and at the same time to be exempted of the internal duty of compliance. The radical objection of Professor Balthazar is the claim that in the context of Kantian Philosophy it is impossible to admit a critique of the juridical and political reason because the concept of imputation, ground of the normativity in these domains, requires not only the presupposition of free agents, but a true and secure epistemic access to them, which is, according to him, impossible considering that the moral law and the other practical principles are accessible for us only in the first person. In the course of the appraisal of such claims, the article contest that objection arguing that the universal and categorical force of the normative bound experienced by the subject when confronted with the moral law in the first person would ineluctably vanish if, at the same time, he had not been taken by the evidence that the objective reality of the moral principles is secured by multiple instancing. Regarding the difficulties raised by Willaschek and Bouterwek, the article argues that the principle exeundum e statu naturali, as a norm of meta-positive character, prior to the division of practical domains between the doctrine of right and the doctrine of virtue, is the cue both to the understanding of the requirement of unquestioning obedience to the constituted power and to the restriction of the validity of this requirement only in foro externo. El artículo propone un diálogo Sur-Sur acerca de los desafíos que plantea el campo político en la actualidad. Además de las coordinadoras Joice Barbosa y Moira Pérez, participan Silvina Tapia Tapia de Ecuador, Abdourahmane Seck de Senegal y Verónica Figueroa Huencho de Wellmapu, quienes se desempeñan tanto en el ámbito académico como en el campo social mediante el activismo político y/o comunitario, desde el cual producen conocimientos colectivos de carácter situado. A lo largo de la conversación se analizan temas (...) tales como la expresión de formas contemporáneas de neoconservadurismo y autoritarismo, las disputas de los movimientos sociales con la institucionalidad, sus tensiones con un Estado que tiende a la cooptación pero también mantiene profundas lealtades capitalistas y coloniales, y las posibilidades y experiencias de formas alternativas de organización colectiva y comunitaria. Este artigo apresenta estudos sobre o hibridismo presente na poesia simbolista de Florbela Espanca (1894-1930). Temos como objetivo apresentar os resultados de uma investigação realizada sobre os traços híbridos que estão presentes nos sonetos Este Livro..., Eu, Mais Alto, Vaidade e Torre de Névoa, observando de que maneira tais traços se apresentam em cada soneto, suas influências e a contribuição de diferentes estéticas na construção da poesia de Florbela Espanca.

This article focuses on the Omega Point, an essential concept in Teilhard de Chardin’s evolutionary metaphysics. In certain passages about the Omega Point, Teilhard mentions the primeval atom hypothesis, a theory about the beginning of the universe proposed by Georges Lemaître, another contemporary Jesuit priest who was also a scientist. Although Teilhard and Lemaître are essentially evolutionists, besides being Jesuit priests, their evolutionary metaphysics and their philosophies of science are radically divergent, and two important differences are presented here – about (...) the eventual cosmic determinism and about the relationship between scientific knowledge and religious beliefs. This article also shows how Teilhard’s original concept was projected into two cosmological theories in which it reveals an essential transfiguration by losing its initial anthropic and religious matrix – the cosmological anthropic principle, proposed by physicists John Barrow and Frank Tipler, and the Omega Point Theory proposed later by Frank Tipler. Determining what content is expressed by a demonstrative when its reference cannot be determined is a problem for those who assume that demonstrative reference is cognized by interpreters and demonstrative meaning has a mere indicative role. Here, I explore a concept of content that gives meaning a cognitively relevant role, namely, John Perry’s classificatory concept of content. With that purpose, I compare the interpretation of a deictic demonstrative in two cases: for an eavesdropper and a conversational participant, aiming to (...) show that meaning, in the form of reflexive rules, can be recruited to play the role of content when information is scarce. The book carefully details the settler- colonial ideology and logic of elimination that permeated US territorial expansion over the Northwest Territories at the end of the eighteen and the first decades of the nineteenth centuries. Seeing Red thoroughly examines the complex context of dispossession by the US colonial power, centering on Anishinaabeg communities, the “mix- race” population, and the different Indigenous people inhabiting this region. However, the book focuses on what the author names “unthinkable history,” following Michel- Rolph Trouillot’s argument that this region, and the whole continent, was conceived as an unsettled territory instead of belonging to many Indigenous peoples. Thus, the text explores Indigenous and mixed- raced communities’ political imaginaries and imagined futures to retain autonomy and territory.Author Michael John Witgen is a citizen of the Red Cliff Band of Lake Superior Ojibwe and a professor in the Department of History and the Center for the Study of Ethnicity and Race at Columbia University. His research centers on the complex relations between Indigenous people and settler colonizers in the Great Lakes and the Northwest Territories. Seeing Red expands his previous analysis of race, ethnicity, and citizenship intersections, bringing to the fore Indigenous people’s history to rethink the statemaking process in the United States.This book’s pages show that theft lies at the foundation of wealth transfer from Indigenous territories to the United States government and white citizens. The white settler ideology, based on a “doctrine of discovery,” established a stark division between the civilized and uncivilized to rationalize, among other things, the theft of Indigenous people. This is a central argument of the book that signals how the civili zation project underpinning the territorial expansion of the United States was based on the transformation of commons into private property. Indigenous land became critical in the “political economy of plunder” advanced by the state and the meaning of “native” as a racial categorization of exclusion. Chapter 1 explores this economy of plunder by detailing the advancement of the settler frontier through different [End Page 139] mechanisms, such as the treaty policy— subsequently violated by the state— and territory surveying to make land legible for the state and cheap for settlers. However, this crusade to dispossess Indigenous peoples from their territory also rested on the national mythology that strengthened the trope of Indigenous vanishing. The author shows how during the years of the study, the Indigenous population was not vanishing but immersed in an intricate social world and transregional trade networks. Chapter 2 explores such context, following the story of an Ojibwe man to evidence the context in which settlers and federal officials relied on Indigenous customs to profit from the fur trade while using ties with communities to further land cessions.Mix- race families played a crucial role in expanding the settler frontier through treaty negotiations but remained marginalized as they identified themselves as both Natives and US citizens. Considero que ambos son de interés en sí mismos por su carácter inédito, pero creo, además, que es posible establecer sugerentes relaciones entre ellos y algunas posiciones contemporáneas, tanto de las ciencias naturales como de (...) las ciencias sociales. En el primer caso, haré referencia al libro recientemente publicado de Friedrich Hülster, Introduction to Wittgenstein´s Tractatus Logico-Philosophicus. For Charles Sanders Peirce, the criterion for the intellectual work and for the conduct of the life of a thinker was absolute rigor in the construction of concepts and strict experimental verification - this outlook caused a complete separation of scientific and philosophical work from any apologetic function. The view that all knowledge of the world of experience and even the knowledge elaborated by Mathematics is intrinsically probable and fallible opposed every and any dogmatism and even the "a priori" of (...) the Kantian tradition. The interest for the evolutionary theory and the unshakable coherence of Pierce's philosophy and attitudes as a professor and a researcher arose strong resistance in the university and editorial world of his time. At a time of serious crises in the North-American university which came as a consequence of the political and economic developments after the Civil War, Peirce's firm position certainly brought about his dismissal from Harvard and John Hopkins Universities, as it also made it difficult for him to publish and it also contributed to his total isolation in the last years of his life.A produção científica e filosófica de Charles Sanders PEIRCE, exigindo como critério para o trabalho intelectual e para a conduta da vida do pensador o absoluto rigor na construção dos conceitos e a estrita verificação experimental, teve por conseqüência desvincular o trabalho científico e filosófico de qualquer função apologética. A afirmação de que todo conhecimento do mundo da experiência e mesmo daquele elaborado pela matemática é intrinsecamente provável e falível se opôs a todo e qualquer dogmatismo e mesmo ao "a priori" de tradição Kantiana. O interesse pela teoria evolucionista e a coerência inabalável da filosofia e das atitudes de PEIRCE, como professor e pesquisador, encontraram profunda resistência no meio universitário e editorial de seu tempo. Num momento de grave crise na Universidade norte-americana, decorrente das transformações econômicas e políticas ocorridas com a guerra da Secessão, o posicionamento de PEIRCE contribuiu muito provavelmente para sua demissão como professor das Universidades de Harvard e de John Hopkins; para dificultar a publicação de seus escritos e para seu total isolamento nos últimos anos de vida. This paper takes the dichotomy between “exclusive” and “inclusive” positivism and applies it by analogy to natural-law theories. With John Finnis, and with Beyleved and Brownsword, we have examples of “exclusive natural-law theory,” on which approach the law is valid only if its content satisfies a normative monological moral theory. The discourse theories of Alexy and Habermas are seen instead as “inclusive natural-law theories,” in which the positive law is a constitutive moment in that it identifies moral rules and (...) specifies their meaning.
